border_type=&#8221;simple&#8221; column_border_width=&#8221;none&#8221; column_border_style=&#8221;solid&#8221;][vc_column_text]Delta State University maintains a federally certified Institutional Review Board which has been established to protect the rights and welfare of human research subjects recruited to participate in research activities conducted under the auspices of the University and other affiliated entities in the region.\u00a0DSU IRB policies are extensions of the\u00a0<a href=\"http:\/\/www.hhs.gov\/ohrp\/humansubjects\/guidance\/belmont.html\" target=\"_blank\" rel=\"noopener\">Belmont Report\u00a0<\/a>(1979) and the\u00a0<a href=\"http:\/\/www.hhs.gov\/ohrp\/humansubjects\/guidance\/45cfr46.html\" target=\"_blank\" rel=\"noopener\">Code of Federal Regulations, Title 45, Part 46<\/a>, also known as 45CFR46.\u00a0Both of these documents can be found and downloaded from the Health and Human Services (HHS)\u00a0<a href=\"http:\/\/www.hhs.gov\/ohrp\" target=\"_blank\" rel=\"noopener\">Office of Human Research Protections (OHRP)<\/a>.\u00a0The federal regulations apply to \u201call research involving humans subjects conducted, supported, or otherwise subject to regulation by any federal department or agency.\u201d\u00a0However, DSU has adopted the federal regulations as its institutional policy and all human subject research, regardless of funding support, is subject to these regulations.<\/p>\n[\/vc_column_text][divider line_type=&#8221;No Line&#8221;][tabbed_section style=&#8221;default&#8221; tab_id=&#8221;1758742302854-10&#8243; id=&#8221;1758742302854-2&#8243;][vc_column_text]\n<h3><strong>Historical Incidents Related to Human Subjects Protections<\/strong><\/h3>\n<ul>\n<li><strong>Hippocrates<\/strong>\u00a0(400 BCE) and Oath: \u201cDo no harm \u2026\u201c<\/li>\n<li><strong>Individual responsibility of researcher<\/strong>\u00a0\u2013 two millennia<\/li>\n<li><strong>Walter Reed<\/strong>\u00a0(1900) Consent forms in Spanish and English: malaria research<\/li>\n<li>Nuremburg Code (1946) Twenty-six medical researchers from holocaust tried for unethical conduct toward \u201cvulnerable\u201d population. Rules and principles developed.<\/li>\n<li><strong>Wichita, Kansas<\/strong>\u00a0(1950\u2019s) Secret audio taping of jury deliberations for legal research. University of Chicago challenged in Congress by James Eastland (of Ruleville, MS).<\/li>\n<li><strong>NIH Clinical Research Center at Bethesda<\/strong>\u00a0(1960) sets up internal review committee and many other research hospitals voluntarily follow suit.<\/li>\n<li><strong>Thalidomide<\/strong>, an experimental drug in Europe was allowed for use in the United States with waiver of clinical trials by FDA(1962). Those receiving drug were not warned that it was still \u2018experimental\u2019.<\/li>\n<li><strong>Sloan-Kettering<\/strong>\u00a0conducts research using \u201clive\u201d cancer cells on humans (1963). Subjects were told that research was testing their resistance to cancer, but not that they would receive live cancer cells. One MD tried to stop it and took Sloan-Kettering to court where defendants were convicted of assault &amp; battery. Malpractice was also shown.<\/li>\n<li><strong>James Shannon<\/strong>\u00a0(1964) at NIH reviews protections for all human subjects in NIH funded research. Agency begins taking a leading role in protecting human subjects.<\/li>\n<li><strong>Stanley Milgram<\/strong>\u00a0(1965) conducted famous research on \u2018obedience\u2019, using deception as part of the design. Despite debriefing, a strong outcry from other professionals.<\/li>\n<li><strong>Henry K. Beecher<\/strong>\u00a0(1966) reviewed biomedical research literature and showed that human subjects protections were violated in over 500 papers. His analysis was published in the New England Journal of Medicine and in two books (see References).<\/li>\n<li><strong>PHS research on untreated syphilis<\/strong>\u00a0(1972) was initiated in the Alabama in the 1930\u2019s. The longitudinal project continued for years, and even after the use of penicillin, 300+ African American subjects were left untreated (and uninformed). Senator Edward Kennedy challenged this research in Congress.<\/li>\n<li><strong>The National Research Act<\/strong>\u00a0(1974) was passed by Congress. IRB\u2019s were established and a National Commission for Protection of Human Subjects was established.<\/li>\n<li><strong>The Belmont Report<\/strong>\u00a0(1978) was published, based on the Presidentially commissioned work of MD Psychologists, Lawyers, and Biomedical and Behavioral Ethicists. This beautifully reasoned and written document proposed to go beyond \u201crules and regulations\u201d to propose principles to use in judgments about protecting human subjects.\n<ul>\n<li>Respect for Persons<\/li>\n<li>Beneficence<\/li>\n<li>Justice<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text]\n<ul>\n<li><strong>Vulnerable subject samples<\/strong>\u00a0(1980-present). More recently, guidelines and regulations have been developed to guide researchers on protecting rights of \u201cvulnerable\u201d subjects including economically disadvantaged, minority, prisoners, mentally incompetent, pregnant mothers, fetuses, and even fetal tissues. While these issues are important, the volume of effort by Congress and federal agencies clearly illustrate political implications, rather than the moral or ethical considerations which are more important.<\/li>\n<li>Recent Controversies and Issues\n<ul>\n<li>Undue Inducement<\/li>\n<li>Duke University<\/li>\n<li>Third Party Informed Consent (Oral History and the Human Genome Project)<\/li>\n<li>Johns Hopkins \u201cAn artist\u2019s reply to just criticisms \u2026\u201d. Dimitri Shostakovitch.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n[\/vc_column_text][\/tab][tab icon_family=&#8221;none&#8221; title=&#8221;The Nuremburg Code&#8221; tab_id=&#8221;1758742302886-2&#8243; id=&#8221;1758742302886-4&#8243;][vc_column_text]\n<h3><strong>The Nuremburg Code<\/strong><\/h3>\n<p>Following the atrocities in medical research during the Holocaust of WWII, this code was developed to provide specific rules intended to prevent future abuse of research subjects. The Nuremburg Code differs from the later Belmont Report in that the later developed general principles and provided far more depth of understanding for research ethics.<\/p>\n<ol>\n<li>The voluntary consent of the human subject is absolutely essential.<\/li>\n<li>The experiment should be such as to yield fruitful results for the good of society, unprocurable by other methods or means of study, and not random and unnecessary in nature.<\/li>\n<li>The experiment should be so designed and based on the results of animal experimentation and a knowledge of the natural history of the disease or other problem under study that the anticipated results will justify the performance of the experiment.<\/li>\n<li>The experiment should be so conducted as to avoid all unnecessary physical and mental suffering and injury.<\/li>\n<li>No experiment should be conducted where there is an a priori reason to believe that death or disabling injury will occur; except, perhaps, in those experiments where the experimental physicians also serve as subjects.<\/li>\n<li>The degree of risk to be taken should never exceed that determined by the humanitarian importance of the problem to be solved by the experiment.<\/li>\n<li>Proper preparations should be made and adequate facilities provided to protect the experimental subject against even remote possibilities of injury, disability, or death.<\/li>\n<li>The experiment should be conducted only by scientifically qualified persons. The highest degree of skill and care should be required through all stages of the experiment of those who conduct or engage in the experiment.<\/li>\n<li>During the course of the experiment the human subject should be at liberty to bring the experiment to an end if he has reached the physical or mental state where continuation of the experiment seemed to him to be impossible.<\/li>\n<li>\u00a0During the course of the experiment the scientist in charge must be prepared to terminate the experiment at any stage, if he has probable cause to believe, in the exercise of the good faith, superior skill and careful judgment required of him that a continuation of the experiment is likely to result in injury, disability, or death to the experimental subject.<\/li>\n<\/ol>\n[\/vc_column_text][\/tab][tab icon_family=&#8221;none&#8221; title=&#8221;Procedure Policy&#8221; tab_id=&#8221;1758742302905-1&#8243; id=&#8221;1758742302904-10&#8243;][vc_column_text]\n<h3>University Procedure Policy<\/h3>\n<p>DSU has adopted definitions of \u201cresearch\u201d and \u201chuman subjects\u201d in accordance with the Code of Federal Regulations, Title 45, Part 46 (45CFR46): Protection of Human Subjects.\u00a0These definitions are as followed:<\/p>\n<p><strong>Research<\/strong>\u00a0\u2013 a systemic investigation, including research development, testing, and evaluation, designed to develop or contribute to generalizable knowledge<br \/>\n<b>Human Subjects<\/b>\u00a0\u2013 living individual(s) about whom an investigator (whether professional or student) conducting research obtains (1) data through intervention or interaction with the individual, or (2) identifiable private information.<\/p>\n<p><strong>Select to view the full University\u00a0<a href=\"https:\/\/www.deltastate.edu\/policies\/policy\/university-policies\/academic-and-administrative-operations\/institutional-review-board\/\">Procedure Policy<\/a>.\u00a0<\/strong>[\/vc_column_text][\/tab][tab icon_family=&#8221;none&#8221; title=&#8221;IRB Process and Forms&#8221; tab_id=&#8221;1758742302919-7&#8243; id=&#8221;1758742302918-7&#8243;][vc_column_text]\n<h3><strong>IRB Process and Forms<\/strong><\/h3>\n<p>Faculty, student, and other persons conducting research in collaboration with Delta State must fill out the one page\u00a0<a href=\"https:\/\/www.deltastate.edu\/PDFFiles\/Academic%20Affairs\/irb\/IRB-Form-A.pdf\"><strong>Request for IRB<\/strong><strong>\u00a0Clearance Form A<\/strong><\/a>. Required attachments include letters of Informed Consent and Assent, and copies of all surveys and questionnaires. For more information, see <strong>Appendix A:\u00a0Criteria for Informed Consent and Assent<\/strong>.[\/vc_column_text][vc_column_text][toggles] [toggle title=&#8221;Appendix A:\u00a0Criteria for Informed Consent and Assent&#8221; color=&#8221;Accent-Color&#8221; id=&#8221;b1&#8243;] The following information must be communicated in writing to all research subjects or respondents before they agree to participate in a project that qualifies for IRB Clearance. The information must be incorporated into a cover letter or information sheet to be distributed with a questionnaire or other survey instrument. Researchers are required to develop a consent form to be signed by each research subject. Additional elements of informed consent may be required for some projects. Following are the minimum required elements of informed consent.<\/p>\n[divider line_type=&#8221;No Line&#8221; custom_height=&#8221;30&#8243;]\n<p>Additional information may be included at your discretion:<\/p>\n<ol>\n<li>a statement identifying the researchers and their affiliations.<\/li>\n<li>an invitation to participate in the study as part of a research project.<\/li>\n<li>an explanation of the purpose of the research, the expected length of time of the subject\u2019s involvement, a description of the procedures to be followed, and identification of any procedures which are experimental in nature.<\/li>\n<li>a description of any benefits to the subject or others which may reasonably be expected from the research.<\/li>\n<li>a description of compensation (if any) for participation (money, extra course credit, etc.).<\/li>\n<li>a statement describing the subject\u2019s anonymity or the extent to which confidentiality of records identifying the subject will be maintained.<\/li>\n<li>the names, addresses, and phone numbers of the people to contact for answers to questions about the research, and the office to contact for questions about the rights of research subjects.<\/li>\n<li>an assurance that participation is voluntary and that the subject may withdraw from participation at any time.<\/li>\n<li>for subjects under 18 years of age (or custodial adult) parental consent is required for any research in the expedited or full review categories. The IRB may waive that requirement under special circumstances. Written consent of a school administrator is required for all research, whether exempt or not.<\/li>\n<li>for subjects under 18 years of age, a statement of informed \u201cAssent\u201d is required. \u201cAssent\u201d refers to the willingness of the research subject to participate. Thus, if the research subject is a minor (under 18 years of age) both parental (custodial) consent and \u201cAssent\u201d are required. [\/toggle] [\/toggles]<\/li>\n<\/ol>\n[\/vc_column_text][vc_column_text]If an application is judged to have \u2018minimal risk\u2019 it will be classified as\u00a0<strong>EXEMPT<\/strong>\u00a0from further IRB review. For details, see\u00a0<strong>Criteria for Exempt Status Appendix B<\/strong>.[\/vc_column_text][vc_column_text][toggles] [toggle title=&#8221;Appendix B: Criteria for Exempt Status&#8221; color=&#8221;Accent-Color&#8221; id=&#8221;b1&#8243;] Most research activity at Delta State will fall under the category EXEMPT FROM IRB REVIEW. When the Request for IRB Clearance is submitted, the IRB Chair will determine whether it is EXEMPT. As soon as the research is classified as EXEMPT, the researcher may proceed.<\/p>\n[divider line_type=&#8221;No Line&#8221; custom_height=&#8221;30&#8243;]\n<p>The criteria stated below must be met in order to qualify for the exempt status. However, research described in category 2 below that is supported by federal funds and which involves subjects under the age of 18 may not be certified as exempt. An exception may be made if the research subject is enrolled in college. If the project otherwise meets the above criteria for exempt status, it may be reviewed by expedited procedures. Questions regarding the protection of human subjects should be submitted to the Chair of the IRB.<\/p>\n<ol>\n<li>Research conducted in established or commonly accepted educational settings, involving normal educational practices, such as (a) research on regular and special education instructional strategies; or (b) research on effectiveness of or comparison among instructional techniques, curricula, or classroom management methods.<\/li>\n<li>Research involving the use of educational tests (cognitive, diagnostic, aptitude achievement), survey procedures, interview procedures or observation of public behavior, unless a research subject will be under 18 years of age*. However, such research is NOT EXEMPT if a) information obtained is recorded in such a manner that human subjects can be identified, directly or through identifiers linked to the subjects; or (b) any disclosure of the human subjects\u2019 responses outside the research could reasonably place the subjects at risk of criminal or civil liability or be damaging to the subjects\u2019 financial standing, employability, or reputation.<\/li>\n<li>Research involving the use of educational tests (cognitive, diagnostic, aptitude, achievement), survey procedures, interview procedures or observation of public behavior that is not exempt under category 2, may be considered EXEMPT if (a) the human subjects are elected or appointed public officials or candidates for public office; or (B) confidentiality of the personally identifiable information will be maintained throughout the research and thereafter.<\/li>\n<li>Research involving the collection and study of existing data, documents, records, pathological specimens, if these sources are publicly available or if the information is recorded by the investigator in such a manner that subjects cannot be identified, directly or through identifiers linked to the subjects.<\/li>\n<li>Research and demonstration projects which are conducted by or subject to the approval of federal department or agency heads, and which are designed to study, evaluate, or otherwise examine (a) public benefit or service programs; (b) procedures for obtaining benefits or services under these programs; (c) possible changes in methods or alternatives to those programs or procedures; or (d) possible changes in methods or levels of payment for benefits or services under those programs.<\/li>\n<li>Taste and food quality evaluation and consumer acceptance studies, (a) if wholesome foods without additives are consumed: or (b) if a food is consumed that contains a food ingredient at or below the level and for a use found to be safe, or agricultural chemical or environmental contaminant at or below the level found to be Safe, by the Food and Drug Administration or approved by the Environmental Protection Agency or the Food Safety and Inspection Service of the U.S. Department of Agriculture. [\/toggle] [\/toggles]<\/li>\n<\/ol>\n[\/vc_column_text][vc_column_text]If risks are considered greater than minimal, research may still be eligible for\u00a0<strong>EXPEDITED REVIEW\u00a0<\/strong>by three IRB members. For details, see the\u00a0<a href=\"https:\/\/www.deltastate.edu\/graduate-and-continuing-studies\/institutional-review-board\/policy\/\" target=\"_blank\" rel=\"noopener\"><strong>Expedited Review section of the IRB\u00a0Policy<\/strong><\/a>.<\/p>\n<p>If any phase of externally funded research, including the write-up, extends beyond one year, researcher will submit a\u00a0<a href=\"https:\/\/www.deltastate.edu\/include\/IRB%20Form%20B.docx\"><strong>Request for Continuing IRB\u00a0Review Form B<\/strong><\/a>.<\/p>\n<p>Research which does not qualify for\u00a0<strong>EXEMPT<\/strong>\u00a0status or\u00a0<strong>Expedited Review\u00a0<\/strong>must have a\u00a0<strong>FULL\u00a0IRB\u00a0REVIEW<\/strong>.
